Commission Terms of Service

                    By commissioning me, you agree to these rules;
 

• You must be at least 18 years old to purchase a commission from me.
   

• Please have your payment ready at hand, you have 24 hours to pay or your commission will be declined.
   

• I only accept FULL PAYMENTS, no partial payments.
   

• Do not attempt to haggle down my prices, they are set and will not change for you.
   

• I will let you know the turnaround time once the payment has been completed. Expect the completion time to be a MONTH. Do not harass me asking when it will be done, I will finish when I finish it. Please be patient.
  
  
          Upon receiving a commission, the buyer may;
   

• Publicly post the artwork that I have given them, along with proper credit by linking to my page or mentioning me on my social media @beastlygemstone
   

• Use any part of the image as an icon or avatar for social media
  
         Upon receiving a commission, the buyer may NOT;
   

• Use the image to promote sales/advertise/generate income in ANY way, shape or form. My commissions are for non-commercial, personal use ONLY. 
   

• Sell the artwork as an NFT or any other digital or physical product (this will result in an immediate ban from all my services)
   

• Edit out my signature or watermark from the original image.
   

• Trace, make bases out of, or replicate the original artwork.
   

• Claim the image as their own creation, regardless of how much of the image has been edited or how it's been used.
   

• Use for any form of AI. I do not support AI “art” in any way, shape or form. Doing so will get you permanently blacklisted from any future sales or commissions. 
   

• Role-play with my art. I do NOT allow anyone to use my art for role-playing purposes, even if asked for permission. I will ALWAYS say NO.
  
  
  
   

• I, the artist will retain all legal and artistic rights to the image being commissioned. I can use the commissioned image in my portfolio and galleries as I see fit.
   

• I will not begin working on the commission until full payment is received within 24 hours of me accepting your application and/or sending you a PayPal invoice. Please have your payment ready at hand.
   

• If buyer does not respond to commission payment inquiries OR complete their payment within 24 hours after the invoice is sent, their commission slot will be revoked.
   

• Only PayPal and CashApp payments are accepted.
   

• Payments in USD only! I don’t accept anything else (No crypto and the like).
   

• After payment is received, I will begin working on the sketch. During the sketch phase, the buyer may make any changes necessary; however the buyer is limited to only 2 MAJOR changes on the sketch (Aka changes to the sketch/lineart). After those 2, you will be charged a fee of $20 per extra change. They are also limited to 4 MINOR changes (small fixes, adjusting parts of the sketch, etc). After those 4, you will be charged a fee of $5 per extra change. You must pay the fee before I continue working on it however.
   

• I will occasionally provide WIP’s of the artwork. If the buyer wants to request an update, I will provide.
   

• There will be no changes to the final product unless I’ve missed a small detail (for example, a facial marking). However if that is not the case and they would like big changes to the final product, I will charge a fee (amount will change depending on what is asked for).
   

• If buyer files a chargeback or dispute for any reason without contacting me first and waiting at least 7 days for a response, they will automatically be banned from all of my future services.
   

• After a buyer purchases my services, it CANNOT be refunded unless I feel that I am unable to do the buyers commission. However, I cannot reliably refund a commission due to the fact the money would have been already spent during the time I would be working on a commission. In that case, a partial refund or other solutions can be arranged.
   

• These rules may be subject to change at any time.
  
  Anyone caught breaking the TOS will be contacted with a warning message. Depending on the case, the rule-breaker may also be blocked, banned from future artwork related services, have their commission cancelled and/or have their slots revoked.
  
  Breaking the T.O.S. repeatedly or conducting a single severe breaking of the rules will result in a possible callout for very serious cases and the rulebreaker(s) being blocked and blacklisted.
